Good luck today. I'm still betting they settle before the case gets to the judge so they don't make case law on this situation and set a precedence that can be applied in future events.
I'd love to be a bug on the wall in the judges chambers today.

Unfortunately the Constable was correct. Irregardless of whether the firearm was holstered , in plain view or a valid permit was in hand.. The LAW cites--NO Guns in a Polling /Voting area. The Constable could have arrested him on the spot, or simply ejected the man and alerted the Manager of the Polling facility to decline him the right to vote, excpet by abseentee ballot. There is no defense --it's the law. The person should simply abided by the Law.. and left his gun at HOME.
Amemded moments later----See Pa Title 18 It cites in pertinant part thereto, that no person--other than law enforcement may carry a weapon upon or within any Govt office, county facility, schools or other facilities of govt operations. Election/olling places are RENTED by each county---this makes that place a particular satelite of the county Board of elections--and ONLY the Elected Constable may be armed... If I recall that law pertains to active duty law enforcement, for the purposes of eliminating any intimidation from the government. In fact, I don't even believe the constable has powers of arrest like a LEO does, only for serving specific warrants.

The Constable has "on view" power of arrest - just like you do as a citizen.
