LOL well the first time i called i got a status over the phone i figured since things are so messed up down there that everyone has their own different rules.

Um, i dont believe it is intercepting if you are a party to the conversation. I know that in NY you can record your own conversation unless you are an attorney, then ethical requirements require you to inform the other party you are recording them. Then they hang up.

The things this guy is doing are difficult to sue over. By the time your lawsuit is filed you have a permit (and who wants to pay a lawyer when you know it is coming, albeit late). Same with his silly rules. unless he tries to enforce them against you, you can not sue.
The ultimate answer is when his term is up start a publicity campaign or tell the guy running against him that "Sheriff ________ does not Follow the Law" "Do you want a Sheriiff who does not follow the Law", or something more clever, but you get the idea. Or you can start now and boycott in front of his office with nice big signs and make sure the media is there to watch you get arrested. But get a permit to picket and make sure it is legal to picket there first! |

Arrogance from a public worker cannot be tolerated. I try to get every thing in writing or at least have a witness present. I have also found making an appointment with the person helps because you then not only put a face on the problem(yours) but they now know they're actions or in-actions being watched. You'd be surprised what happens when you ask for a FOIA(Freedom of Information Act) form, while looking this clown in the eye.

you cited a wire-tapping statute, you are not wire-tapping/intercepting when you make the call or receive the call. However, comments from a PA atty would be helpful.
