Either way, it is much easier to blow someone off over the phone than it is to just ignore and be rude to someone standing in front of you. I would go down and ask when it will be approved. If the person working the desk has no clue ask to speak to the sheriff, if he is not there I would say you will wait for him. They keep telling you that you have to ask in person, if I took the time to go down there I damn sure would know whats up before I leave.

+1.

Also what not to do:

Nor pose as a county employee placing an ad in the paper "advertising" free permits, no background check, drive-thru service, no waiting. They'd have riots. It would be most unfortunate for the Delco authorities, as Charley Chan used to say.

Not only is a recording of a phone conversation without all parties knowlege/consent "not admissible" It is also a felony to use such an illegally aquired recording.
Um, i dont believe it is intercepting if you are a party to the conversation. I know that in NY you can record your own conversation unless you are an attorney, then ethical requirements require you to inform the other party you are recording them. Then they hang up.

The things this guy is doing are difficult to sue over. By the time your lawsuit is filed you have a permit (and who wants to pay a lawyer when you know it is coming, albeit late). Same with his silly rules. unless he tries to enforce them against you, you can not sue.

The ultimate answer is when his term is up start a publicity campaign or tell the guy running against him that "Sheriff ________ does not Follow the Law" "Do you want a Sheriiff who does not follow the Law", or something more clever, but you get the idea. Or you can start now and boycott in front of his office with nice big signs and make sure the media is there to watch you get arrested. But get a permit to picket and make sure it is legal to picket there first!

Arrogance from a public worker cannot be tolerated. I try to get every thing in writing or at least have a witness present. I have also found making an appointment with the person helps because you then not only put a face on the problem(yours) but they now know they're actions or in-actions being watched. You'd be surprised what happens when you ask for a FOIA(Freedom of Information Act) form, while looking this clown in the eye.

Not correct in PA.
See the statute I cited. PA is an ALL party consent.
There are exceptions, but the telephone, as a civilian, is not one of them.

(This was montgomery county by the way, I've moved to Bucks since then.)

Bucks (in compliance with state law) doesn't require a separate background check from you local PD.

you cited a wire-tapping statute, you are not wire-tapping/intercepting when you make the call or receive the call. However, comments from a PA atty would be helpful.
