I was down at the Dauphin county courthouse today and picked up a booklet on PA Firearm Laws.
In there it defines firearm as a pistol or revolver with a barrel length 15" or smaller, shotgun with a barrel length of 18" or smaller, and a rifle with 16" or smaller barrel length OR any gun whose overall size is less than 26". My question is, am I able to open or conceal carry an AK-47 / WASR / AKM / AR15 etc? Could I walk downtown Harrisburg with my AK stock collapsed and slung over my shoulder? Granted I would never do that, but I thought it was a compelling question. Also, something to note: If Eddy Rendell calls a "state of emergency" or if the feds call a state of emergency, it is illegal to have a firearm on or around you unless you are using it in self defense of yourself or property (even if you have a permit to carry). Thought that was interesting because if a state of emergency is called, I can see PA turning into New Orleans very quickly. Last edited by jujubee; May 29th, 2008 at 04:05 PM. |

XD, section 6107 states:
"No person shall carry a firearm, rifle, or shotgun upon the public streets or upon any public property during an emergency proclaimed by a state or municipal government executive unless the person is (1) Actively engaged in a defense of that person's life or property from peril or threat. (2) Licensed to carry firearms under section 6109 or is exempt from licensing under section 6106(b)" I think you may be right then unless I am reading it wrong. There is no "OR" at the end of section 1. So I guess you could carry during a state of emergency, but you had better be able to prove in the court of law that you were in peril...pretty loose language if you ask me which could be good or bad depending on the lawyer you have. Either way, the real question I want answered in this thread, without any doubt is: Can I walk the streets of downtown Harrisburg, including the state capital with my WASR slung on my shoulder and a magazine loaded? Obviously I would expect to have Harrisburg CRT (crisis response) there in minutes because heck, if I saw someone open carrying an AK I would be calling 911 ASAP. |

I do not plan on doing this and explained in the other thread that if I saw someone open carrying an AK I would be on the phone ASAP and expect to see Harrisburg CRT team there in minutes. |

Legally, yeah I think you're allowed, but... I'd expect SWAT to show up real quick.

Do you think there would be a charge of public disturbance or disturbing the peace or something like that?
OC a pistol and you get some crazy stories of people saying (from what I have read on this message board) that people claimed they were waving their gun around when in fact they were not, people just seem to over exaggerate when they see a gun in public not on a LEO. Seeing someone walking down front street with an AR or AK, people would claim you were a terrorist. |
