Great, so when is the civil suit against the sheriff's office coming? They will do this shit again unless it costs them something.

Very true. It was only after I stopped thinking about this in terms of OC, and wether I personally like the idea or not, that I saw this as being not about OC or even gun rights in general. But as being about the abuse of an elected office to enforce not laws, but opinions and personal vendetta's. People with such egos as this should not be allowed the honor of sevice.

On the subject of abuse of power, several posters have asked for an "After Action Report" and I was wondering if it could include something that I have pondered since the very beginning of this difficult incident.
Specifically, it seems that a "Shall Issue" state isn't a true "Shall Issue" state if law enforcement (and I use that term loosely) can arbitrarily revoke a LTCF at random. It seems that at the very least, Greg needs to have his legal fees reimbursed, compensated for any lost work time and probably compensated for the significant mental anguish he must have experienced. Even if there is a generally accepted formula for putting a numerical dollar value on this compensation, it would at best only address half the problem. The other half of the problem (as I see it) is that there should be some sort of sanction against the LEO that pursued the revocation when it was clear to everybody (on both sides) that there was no basis for a revocation. In other words (as MarcS noted), if the there is no significant disincentive for any LEO to arbitrarily revoke a LTCF, what would stop them from doing it again? Maybe some of the lawyers that post here can let us know the theory about how this type of compensation might work or alternatively why the law would make no provision to mitigate against this type of LEO abuse. Kudos to Greg for seeing this through and congratulations on winning.

A memorable and appropriate quote from the film Open Range:
Boss Spearman: It's a pretty day for making things right. It certainly was a pretty day and thing were made right. I'm looking forward to press accounts of the hearing.

Does anyone know if this judge is going to have this ruling be a published or unpublished decision?
Makes good case law for all of us if it’s a recorded decision. Congratulations Greg on having you LTCF permit returned. |
