TOWNSHIP OF LOWER CHICHESTER
LINWOOD, DELAWARE COUNTY, PENNSYLVANIA
ORDINANCE NO; 2008-03
An Ordinance of the Township of Lower Chichester, Linwood,
Delaware County, Pennsylvania, Requiring the Disclosure of
Firearms, Handguns, Rifles, Shotguns, Ammunition and
Gunpowder on Premises
WHEREAS, the, annual sales of firearms in the United States is ever increasing; and,
WHEREAS, firearms, and especially handguns, play a major role in the commission of homicide, aggravated assaults and armed robberies; and,
WHEREAS, the improper storage of firearms and ammunition is a major factor in accidental deaths and injuries in homes; and,
WHEREAS, improper storage of or use of firearms and ammunition causes great harm to firemen police officers and other public officials and,
WHEREAS, The Board of Commissioners of the Township of Lower Chichester has found and determined that the convenient availability of firearms and ammunition has increased the incident of firearm related deaths and injuries; and,
WHEREAS, the Board of Commissioners of Lower Chichester Township has found and determined that it is necessary and desirable to protect the residents of the Township of Lower Chichester, from the loss of property, and injuries or death, from firearms and exploding ammunition; and,
WHEREAS, the Board of Commissioners of Lower Chichester Township has found and determined that proper disclosure of firearms and ammunition in the community will aid in achieving these goals.
NOW, THEREFORE, be it ordained by the Board of Commissioners of the Township of Lower Chichester, as follows:
l. That in any incidents whereby a Certificate of Occupancy is required prior to sale or lease, pursuant to Chapter 1446, Section 1444.03, that the applicant, seller, buyer, owner and/or tenant, must disclose on said application whether there are any firearms, handguns, rifles, shotguns, ammunition, or gunpowder, of, said premises, by setting forth the type of firearms, the number of firearms, the type of ammunition., the type of gunpowder, and the amount of said ammunition and/or gunpowder.
2. If said application discloses that there are firearms, rifles, shotguns, ammunition, or gunpowder, on the said premises, then the Zoning Officer shall send a ropy of the said application to the Lower Chichester Township Police Department and to the Lower Chichester Township Volunteer Fire Company.
3. Anyone violating said Ordinance shall be subject to a penalty as outlined on Section 202.99 of the Administration Code for General Code Penalty of the Codified Ordinances of Lower Chichester Township, Linwood, Delaware County, Pennsylvania.
DULY ENACTED AND ORDAINED, this day of 2008, by The Board of Commissioners of Lower Chichester, in public session duly assembled.
