Senator Robbins Introduces "Stand Your Ground" Bill
Would bar prosecution of those defending themselves in an attack
Those protecting themselves from an attacker should not have to also worry about protecting themselves from prosecution later, according to Senator Bob Robbins (R-50).
With that in mind, Senator Robbins is introducing Senate Bill 1173, which would provide protection from criminal prosecution and civil litigation for those who defend themselves when threatened by an attacker in any place an individual has a right to be.
"My legislation is commonly called the "Stand Your Ground" bill," Senator Robbins said. "Senate Bill 1173 presumes that an attacker or intruder intends to do great bodily harm and therefore force -- including deadly force -- may be used to protect yourself, your family and others in the face of danger. However, an individual would still need to demonstrate a reasonable belief that he or she was in imminent danger to use lethal force."
So far 14 states (Arizona, Florida, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Michigan, Oklahoma, South Carolina, South Dakota, Tennessee and Texas) have enacted "Stand Your Ground" laws.
Senate Bill 1173 has been referred to the Senate Judiciary Committee for consideration.
